Estate Planning |

Probate

What estate planning services do you offer?

We can assist with the drafting and execution of wills, trusts, power of attorney, declaration of guardian, and any other documents you might need to get your affairs in order. We can also update existing estate planning documents.

Why do I need an estate plan?

A comprehensive estate plan will help you make sure that your assets are distributed according to your wishes. If you have minor children, you can also choose who will take care of them if you die or become incapacitated. If you want to avoid the probate process - which can be lengthy and expensive - you can create a trust, which bypasses probate proceedings.

How often should I review or update my estate planning documents?

You should review your documents every three to five years. If you have had any changes in your family during that time - like a divorce, remarriage, or new children - you should contact an attorney to make sure those changes are reflected.

What is probate?

Probate is the legal process of settling the affairs of a deceased person. If a person has a will when they pass away, the person they named as executor will be responsible for overseeing the probate process for the deceased’s estate. If that person didn’t have a will, their family can use a Small Estate Affidavit, an Affidavit of Heirship, or a Determination of Heirship to manage the estate.

Intellectual Property Law

What kind of business law services do you offer?

We can assist with the formation of your business, including drafting and filing required business formation documents. We can also help you update your existing documents to incorporate any changes that may have occurred since you started your business. We also assist with drafting contracts and issues related to employee handbooks.

Why should I hire a business law attorney?

An attorney can help you minimize your legal risks during the formation of your business. Having the guidance of an attorney can protect your business assets, ensure the validity of your contracts, and identify potential issues in advance.

What is an LLC?

An LLC (Limited Liability Company) is one of the most common ways to structure a small business. There are several different kinds of business structures - PLLC, INC, LP, LLP, non-profit - that you might consider, depending on the size and type of your business.

What is intellectual property?

Intellectual property can be almost anything you create as a product of your intellect, including inventions, artwork or design, literary works, musical compositions, and much more. Under U.S. law, there are four types of intellectual property: Copyright, patents, trade secrets, and trademarks.

Can you help me file a patent?

We are unable to take patent-related cases. If you are unsure of what type of process you need, please feel free to schedule a consultation so we can advise about the appropriate application or direct you to a patent attorney. People are often confused about the differences between copyright vs. trademark vs. patent.

Why should I register the copyright for my book, song, or artwork?

Registering your work creates a public record of your copyright registration. This will protect your work in case anyone tries to steal it and claim it as their own, and defend you against any allegations of infringement.

Why should I hire an intellectual property attorney?

A knowledgeable intellectual property lawyer can help you protect your creative work.
